The tax-funded National Health system (SNS) underwent a process of decentralisation through which managerial and economic responsibility was devolved to the 17 regions by December 2001. Public hospitals are owned by the state but funded by the regions. However, there have been some experiences towards private management of public hospitals, with public funding. The private health insurance sector has grown in recent years but is still small; there are around eight million people fully insured.

Pharmaceuticals are classified as hospital and retail pharmacy drugs. Market authorisation and pricing & reimbursement remain at a national level, whilst the regions have implemented their own pharmaceutical policies, addressing prescribers and medical representatives particularly. Reimbursement of medicines is selective. Hospital drugs are provided free of charge. For retail pharmacy drugs, co-payment levels are very low, ranging from 0% to 40% for retail drugs. There has been a new reference price system in place since March 2007.

The Spanish pharmaceutical market is the fifth largest in the EU-27. The pharmacy sector represents 76.2% of the market at manufacturers' prices, the remaining 23.8% being hospital sales. Pharmaceutical production continues to increase but recent measures introduced by the government have resulted in slower R&D growth. In July 2006, Spain enforced a new pharmaceutical law. Its development has been polemical, as many industry representatives feel that the government has pushed a law without consensus.

Almirall and Esteve are the leading domestic pharmaceutical producers, with sales of over US$1.0 billion. In October 2007, Almirall entered an agreement to acquire an eight-product portfolio from the UK's Shire Pharmaceuticals. This followed Almirall's acquisition of the German producer Hermal in September 2007. Esteve continues to enhance its market presence in China. Almirall and Esteve's R&D investments have risen sharply in recent years.
